For Buyers: Like any significant purchase, the more information you have before submitting an offer, the better. Request Somerton Forge HOA disclosures, which will include the cost of the transfer fee, before submitting a written offer to save the hassle. If you want to split the transfer fee with the seller, addressing the issue up front will help.

For Sellers: Keep in mind the general range of what is considered reasonable costs for disclosure and transfer fees, so that if you are assessed a charge outside of that range, you will know something fishy might be going on. Also, remember that PA state has a statute that requires a timely response to record requests so that the sale of your home may not be unreasonably delayed.

Real Estate Information

Please make sure to complete the following steps:

  • Request permission FIRST before placing a “FOR SALE” or “FOR RENT” sign on your property.
  • Contact Linda McManus at linda@pinnaclepm.com.
  • Be sure to include your name, address, phone number as well as the name, agency, address, phone number and email address of your real estate agent.

RESALE PACKAGE

The deed to your property identifies certain restrictions such as the fact that your property is part of a homeowner association and, as such, requires the Association to provide documents when a property is transferred.  Settlement of your property may be delayed if the appropriate documents are not provided.  Be sure to keep the Association informed of your intention to sell or rent by contacting Marcie at marcie@pinnaclepm.com.

The Uniform Planned Community Act (UPCA) provides protection to prospective buyers with regard to resales.  Once you have a signed Sales Agreement, you must immediately provide a copy of the Agreement to the Association in order to comply with this law.

Within 10 days, the Association must provide a Resale Package to prospective buyers which includes:

  • 5407 Resale Certificate
  • Current Budget
  • Declaration and By-Laws
  • Insurance Certificate

USE AND OCCUPANCY PERMIT must be obtained from Lower Southampton Township.Before a permit can be issued, inspectors must find that there are no defects.  It is the responsiblity of the Seller/Landlord to make sure the house is in good condition. Under a new state law, the Buyer can agree to do the work instead of waiting for the Seller to perform the required work. However, if the work is not done within 18 months, the new owner can be fined or ordered from the home.
